Terms of Service

1. Who we are

Pitch Time ("we", "us", "our") provides software to help soccer coaches and clubs plan lineups, manage substitutions, and track fair playing time. Our services include the web app at pitchtime.app and related sites, content, and features (the "Service").

By creating an account or using the Service, you agree to these Terms.

2. Eligibility & accounts

You must be an adult (16+ or the local age of consent, whichever is higher). The Service is for coaches, club administrators, and other adults.

You are responsible for your credentials and all activity under your account.

If you register on behalf of an organization, you confirm you have authority to bind it.

3. Clubs and seat management

Club administrators may purchase multiple coach seats and manage access.

The Club controls coach seat assignments and any data entered under that tenancy. We act on the Club's instructions for those accounts.

4. Acceptable use

Don't: break the law; violate others' rights; upload malware; scrape or reverse-engineer; bypass security/rate limits; or misuse player/parent data. You must have permissions/consents to enter personal data. We may suspend or terminate for violations.

5. Your data & ownership

You retain ownership of content you add (e.g., player names, match data).

You grant us a worldwide, non-exclusive licence to host, process, display, and back up your content only to operate and improve the Service.

6. Subscriptions, renewals, refunds

Paid plans are billed in advance and auto-renew unless cancelled.

Prices/taxes/next charge date are shown at checkout.

You can cancel anytime; access remains until the end of the paid period.

Refunds aren't guaranteed; we may consider where required by law.

7. Free trials & promotions

We may change or end promotions.

8. Service changes & availability

We may update features, interfaces, or pricing. We aim for high availability but don't guarantee uninterrupted Service. We'll try to give notice of material changes.

9. Third-party services

We integrate with third parties (e.g., Stripe for payments, Supabase for infrastructure). Your use of third-party services is governed by their terms.

10. Minors' information

Accounts are for adults. If you enter minors' details, you confirm you have appropriate consent or a lawful basis.

11. Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts or modifies any non-excludable consumer guarantees under the Australian Consumer Law.

12. Disclaimers

The Service is provided "as is". We don't guarantee specific outcomes. To the fullest extent permitted, we disclaim all warranties (express/implied).

13. Limitation of liability

To the maximum extent permitted by law, our total liability for all claims in any 12-month period is capped at the greater of (a) amounts you paid us in that period or (b) AUD 150. We're not liable for indirect, incidental, special, or consequential losses.

14. Indemnity

You will defend, indemnify and hold us harmless from claims arising from your content or breach of these Terms.

15. Termination

You may stop using the Service anytime. We may suspend/terminate for cause (e.g., abuse, legal risk, non-payment). Sections that by nature survive will continue.

16. Governing law & venue (Victoria, Australia)

These Terms are governed by the laws of Australia and the State of Victoria. The courts of Victoria, Australia (Melbourne) have exclusive jurisdiction. If you are a consumer and mandatory laws in your residence grant you additional rights, those rights are not affected.

17. Dispute resolution (recommended escalation)

Before court proceedings, the parties will negotiate in good faith. If unresolved in 30 days, either party may refer the dispute to mediation administered by the Resolution Institute in Melbourne under its rules. If still unresolved within 45 days of referral, either party may commence proceedings in the courts of Victoria.

18. Changes to these Terms

We may update these Terms. We'll post the new version with a "Last updated" date and, for material changes, notify you. Continued use means acceptance.
